1. Eligibility

You must be at least 13 years old to use SpinUps. If you are between 13 and 18, you may only use the Service with permission from a parent or legal guardian.

By using SpinUps, you represent and warrant that you meet these requirements.

2. Description of the Service

SpinUps is a fantasy league-style music discovery game that provides features including:

• Artist drafting and team creation
• Head-to-head artist matchups determined by user voting
• Leaderboards, standings, and stats
• Social groups, activity feeds, and "Mic Drop" reactions
• Season-based gameplay with unique content and commentary
• Music playback and previews through Apple Music (via MusicKit)
• Display of artist imagery and album artwork provided by Apple Music APIs

SpinUps is for entertainment purposes only and does not involve gambling or real-money prizes.

3. Use of Apple Music, Audio Content & Artist Imagery

SpinUps integrates with Apple Music through the Apple Music API and MusicKit. By using the Service, you acknowledge and agree that:

3.1 Apple Music Subscription

• Full-track playback is only available to users with an active Apple Music subscription.
• Users without a subscription may only access previews, where permitted.

3.2 Ownership & Rights

All audio, artwork, album covers, artist images, and metadata displayed in SpinUps:

• Remain the property of their respective rights holders
• Are supplied by Apple Music APIs under license
• Are streamed directly from Apple Music (SpinUps hosts no audio files)

You may not copy, download, screen-scrape, redistribute, or use any Apple Music content outside of SpinUps.

SpinUps is not affiliated with, endorsed by, or sponsored by Apple Inc.

4. Account Registration and Security

To use certain features of the Service, you must create an account.

You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Notify us immediately if your account is compromised
• Be responsible for all activity under your account

You may not create multiple accounts to manipulate votes or standings.

5. User Conduct

You agree not to:

• Use bots, scripts, or automation to vote or interact with the Service
• Manipulate matchups, standings, or leaderboards
• Harass, threaten, or abuse other users
• Post spam, malware, or misleading content
• Impersonate others or misrepresent your identity
• Violate any applicable laws or third-party rights

We reserve the right to suspend or terminate accounts that violate these rules.

6. Voting Integrity

SpinUps is built on fair play. Voting is the foundation of the game.

You agree:

• To vote honestly and not attempt to game the system
• Not to use vote manipulation tactics such as multiple accounts, vote trading, or scripted voting
• To accept that SpinUps may void votes or disqualify users for suspected manipulation

We may monitor voting patterns to detect and prevent abuse.

7. Social Features and User Content

SpinUps offers social features including:

• Groups with shared activity feeds
• Comments and reactions ("Mic Drops")
• Leaderboards, standings, and stats

By posting content ("User Content"), you grant SpinUps a non-exclusive, royalty-free, worldwide license to display, distribute, and use that content within the Service.

You retain ownership of your content but agree not to post anything that violates these Terms or applicable laws.

8. Content Moderation Policy

We may (but are not required to) review, edit, or remove User Content at our discretion.

SpinUps may remove content that:

• Is abusive, hateful, or discriminatory
• Contains illegal or harmful material
• Infringes intellectual property rights
• Violates these Terms

We are not responsible for User Content posted by third parties.

9. Intellectual Property

All SpinUps branding, design, software, and original content are owned by Three Nine Ventures LLC.

You may not:

• Copy, modify, or distribute our proprietary materials
• Use our trademarks without permission
• Reverse-engineer or decompile the Service

Artist images, album artwork, and music are provided under license from Apple Music and remain property of their respective owners.

10. Third-Party Services

SpinUps integrates with third-party services including:

• Apple Music (via MusicKit)
• Cloud hosting and infrastructure providers
• Analytics and monitoring tools

Your use of those services is subject to their respective terms and privacy policies. SpinUps is not responsible for third-party service availability or content.

11. Privacy Policy

Your use of SpinUps is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

By using SpinUps, you consent to our data practices as described in the Privacy Policy.

12. Cookie Policy

SpinUps uses cookies and similar technologies to:

• Keep you logged in
• Ensure security
• Measure analytics

You may disable cookies in your browser settings, but this may affect Service functionality.

13. Service Changes and Availability

We may:

• Modify, suspend, or discontinue features at any time
• Remove or change content availability
• Limit access for maintenance or security

We are not liable for any disruption or downtime.

14. Disclaimer of Warranties

SpinUps is provided "as is" and "as available", without warranties of any kind.

We do not guarantee:

• Accuracy or completeness of content
• Reliability of voting systems
• Error-free or uninterrupted service
• Continued access to Apple Music APIs or content
• That the Service will meet your expectations

Use SpinUps at your own risk.

15. Limitation of Liability

To the fullest extent permitted by law, Three Nine Ventures LLC, its officers, employees, contractors, and owners are not liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or reputation
• Content or conduct of other users
• Issues arising from third-party integrations
• Misuse of Apple Music content
• Technical issues, outages, or data loss

Total liability shall not exceed $50 USD.

16. Indemnification

You agree to indemnify, defend, and hold harmless Three Nine Ventures LLC from any claims, losses, damages, liabilities, or expenses arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your actions involving Apple Music content
• Your interactions with other users

17. Termination

We may suspend or terminate your account or access to the Service at any time for:

• Violating these Terms
• Fraudulent or harmful behavior
• Vote manipulation
• Posting prohibited content
• Security or operational concerns

You may delete your account or stop using the Service at any time.

18. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.

Any disputes shall be resolved exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction.

19. Changes to These Terms

We may update these Terms from time to time.

Changes will be posted with an updated "Last Updated" date.

Continued use of SpinUps after updates constitutes acceptance.
